A Brooklyn doctor was arrested for second-degree manslaughter when he turned himself in for performing liposuction on a woman named Isel Pineda whose medical history revealed she had had a heart transplant in 2004 - a fact that should have barred Oleg Davie from going through with the procedure.

As Kings County District Attorney Charles Hynes describes it, "Shortly after the procedure was performed, Ms. Pineda collapsed in Dr. Davie's office, her heart stopped, and she died."

The woman, 51-year-old woman became interested in having an operation done by Davie when she saw an ad for a discount for his office on the Internet.

According to ABC the doctor didn't say anything in court Thursday, though his defense attorney James DiPietro argued that the death, while tragic, wasn't criminal.

"The fact that she had a transplant or not was not the determining factor of her death," he said.

However, prosecutors believe the fact that documentation of Pineda's medical records were allegedly changed by Davie after her death proves culpability.

DiPietro denies this, stating that "sometimes when people are being accused falsely, sometimes panic sets in, and that might have happened here."

Also present was Pineda's brother, Marni Pineda.

"I couldn't believe it, I didn't understand it, I thought it was all a bad dream," he said regarding the loss.

This is not the first time Davie has faced scrutiny over his work. In 2011 the New York State Health Department put him on a 3-year probation after complaints began to roll in.

According to the D.A.'s office, Davie faces a maximum of 34 years in prison.
